About these terms
These terms apply to every use of the Collective Play website and every order placed with us. Collective Play is the trading name of Eden Play Pty Ltd ABN 52 653 111 472 ("Collective Play", "we", "us" or "our").
By using our website or placing an order, you agree to these terms. If you do not agree, please do not use the website or place an order.
Business customers only. Our website and products are supplied to businesses, including early learning and childcare services, for use in their operations. Prices and terms are set on that basis. By placing an order, you confirm you are ordering on behalf of a business.
Other terms. Terms you send us, including on a purchase order, do not apply unless we agree to them in writing. Where you have a separate signed agreement with us, or a quote that states its own terms, those terms apply to that supply and take priority where they differ from these terms.
Changes. We may update these terms from time to time. Changes apply to orders placed after the updated terms are published on our website and do not affect orders we have already accepted.
Orders
An order is an offer to buy. A contract forms only when we accept your order. We may accept or decline any order, and all orders are subject to stock availability.
Once accepted, an order can only be cancelled with our written agreement (see Order cancellations).
Product information. We aim to describe products accurately, including dimensions, materials and age suitability. Colours and finishes may vary slightly from images.
Design changes. Manufacturers sometimes change a product's design or specification. Where this happens, we may supply the updated product or an equivalent alternative of the same or better quality and function. If the change matters to you, contact us before dispatch and we will cancel that item and refund you.
Prices and payment
You pay the price shown when you place your order. Prices may change without notice, but a change does not affect an order we have already accepted.
Prices are in Australian dollars and exclude GST and delivery unless stated otherwise. GST and delivery are shown at checkout and on your tax invoice.
Promotions. Promotions and discount codes may end or change at any time. Unless stated otherwise, one code applies per order and some products may be excluded.
Online orders. Payment is due when you place your order, using a payment method shown at checkout. If payment fails, we may cancel the order.
Account customers. Where we have approved you for a trading account, payment is due within 30 days of the invoice date unless agreed otherwise in writing. Payment is by EFT or another method shown on your invoice, in full and without deduction.
Surcharges. Card and other payment surcharges, where they apply, are shown before you pay and do not exceed our cost of accepting that payment method.
Late payment. If an invoice is overdue, we may charge interest on the overdue amount at 3% per year above the Westpac indicator lending rate, and may suspend further supply until the account is paid.
Delivery, back orders and ownership
Delivery fees depend on the size, type and destination of the goods, and are shown at checkout or on your quote. Bulky, oversized or remote deliveries may cost more.
Delivery times are estimates. We will tell you if we expect a significant delay.
Delivery is complete when the goods are received at your nominated address by you or someone accepting them for you. Risk in the goods passes to you on delivery.
Back orders. Items not in stock when you order are placed on back order and sent when available. We may cancel back-ordered items under $30, or any back order outstanding for more than 4 months, and refund or credit you for them.
Ownership. Goods remain our property until we have received payment in full for them.
Faulty and damaged goods
Your rights under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under that law.
Check your delivery. Please check goods against your order when they arrive. Telling us about transit damage or missing items within 14 days of delivery helps us claim from the carrier and resolve it quickly.
Manufacturer's warranty. In addition to your rights under the Australian Consumer Law, our goods carry a 12-month warranty against manufacturing faults from the date of delivery, unless the product page states otherwise. Under this warranty we will repair, replace, refund or credit the goods.
The warranty does not cover damage from misuse, accidents, alteration, normal wear, or use other than as intended.
How to make a claim. Contact our Customer Service team on 1300 555 972 or at hello@collectiveplay.com.au before returning anything. Please include your order number and photos of the fault or damage. For items that cannot easily be returned, we may arrange an inspection.
Change of mind returns and cancellations
Change of mind. We may accept a change-of-mind return if you contact us within 7 days of delivery and the goods are unused, undamaged and in their original packaging. Return freight is at your cost, and a 20% restocking fee applies to change-of-mind returns. This does not apply to faulty goods.
We do not accept change-of-mind returns for books, customised items, assembled furniture, hygiene items, opened or used items, or products supplied direct by third-party vendors where the product page says so.
Please contact Customer Service on 1300 555 972 or at hello@collectiveplay.com.au before returning anything.
Cancelling an order. You can ask to cancel an order before it is dispatched. If it has already been dispatched, we may deduct the reasonable delivery, return and handling costs we incur from any refund or credit. Card surcharges already paid are not refunded on a cancelled order.
Use of goods and liability
Intended use. Goods are supplied for their described purpose. Please follow the product information, assembly instructions and any age guidance.
Products for children must be used only by children of the recommended age, under appropriate adult supervision. Your service is responsible for deciding whether a product suits a particular child and setting, and for checking, maintaining and using it safely.
Limitation of liability. To the extent the law allows, we are not liable for any indirect or consequential loss, including loss of profit, revenue or business.
Where the Australian Consumer Law allows us to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to repairing or replacing the goods, supplying equivalent goods, or paying the cost of doing so.
General
Intellectual property. The content on our website, including text, images and logos, belongs to us or our licensors. Please do not copy or use it without our permission.
Privacy. We handle personal information in line with our Privacy Policy. Card payments are processed by our payment provider, and we do not store your full card details.
Suspension and termination. If you do not pay an overdue amount, or you become insolvent, we may suspend supply or end the contract for any undelivered goods, and recover amounts owed to us.
Notices. Notices must be in writing and sent by email or post to the contact details on your order or account, or to ours below.
Entire agreement. These terms, your order and any written agreement we have signed with you are the whole agreement for the goods supplied.
Governing law. These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction.
